Generational perspectives and the rule of law concerns rule of law seen through the lens of generations. In this theme articles on criminal justice for youth in Europe may feature, given the increasing evidence of disparities in youth justice, which disproportionately impact the well-being and future life chances of socially disadvantaged youth. Trends of over-criminalisation, that is applying criminal justice to ‘solve’ (social) problems alarmingly seem to have discriminatory side-effects, which may deepen social inequality, impacting current and future generations.
Another generational aspect in relation to the rule of law concerns older persons. To what extent can we assume that their interests remain respected and protected in the face of shrinking resources and increasing public expenses? Furthermore, intergenerational aspects may scrutinize rule of law features such as equality, accountability and legal certainty in this theme.
